General Terms and Conditions for the Use of services at stugknuten.com

Stugknuten provides an intermediary service for cottages, houses, and apartments, giving private individuals and companies the opportunity to advertise their own properties on our website www.stugknuten.com and, accordingly, rent properties directly from the advertiser. The intermediary service Stugknuten is operated by Stugknuten Uthyrning AB, reg. no. 556681-5238, and you can always contact us at info@stugknuten.com. In the following, Stugknuten Uthyrning AB is referred to as “Stugknuten”. It is important to note that Stugknuten shall in no case be regarded as a lessor; we only provide a service for advertising and facilitating contact between users who have registered with the service and wish to rent or let a cottage, apartment, house, or other property. As part of our service, you also gain access to insurance via an insurance intermediary procured by us, and a payment solution provided by our partner MangoPay. Specific terms apply when using these services, which can be found in the General Terms and Conditions for the Booking Service (General terms and conditions for the booking service).

Your contractual relationship with Stugknuten

These General Terms and Conditions lay down the foundation for the contractual relationship between you, as a user of the services, and Stugknuten. We consider it very important that you understand your rights and obligations when using the service, and therefore ask that you read these Terms carefully. Set up an account

In order to access our services, you must first create an account. When doing so, we strongly encourage you to choose a secure password containing both upper- and lower-case letters as well as special characters, making it more difficult for third parties to guess your password and thereby gain access to your account. If you suspect that someone has nevertheless obtained your password, we urge you to change it immediately or, alternatively, contact us at info@stugknuten.com to have your account deactivated. An account may only be created by a person who is at least 18 years old and otherwise legally capable of entering into the agreement that use of the service entails. When placing an advertisement, you will also, for your own safety as well as that of other users, be asked to verify your identity via BankID. We do this to ensure that both lessors and tenants can feel greater confidence when renting through Stugknuten.

The information in your account and in your listings

As a user, you are responsible for ensuring that the information you provide to Stugknuten in connection with the use of the service is accurate. Stugknuten assumes no responsibility for the content of advertisements, including images and other information, as these are provided entirely at the advertiser’s own risk. A fundamental condition for using the service and placing advertisements is that you either own the advertised property yourself or have the owner’s permission to advertise and rent it out. If you, as an advertiser, use material protected by another party’s rights without authorization, Stugknuten is entitled to remove such material from the advertisement or, alternatively, to immediately terminate the advertisement or the user account. In cases where we are forced to remove an advertisement or a user account for the reasons stated above, you are not entitled to a refund of any fees already paid for the services. The content and material in your user account, as well as in advertisements, form part of the intermediary service. We always strive to maintain objectivity in our service, which is why we do not allow material that expresses opinions which may be considered offensive or derogatory. By using the service, you agree to indemnify and hold Stugknuten harmless against any claims made against Stugknuten by another user or a third party due to information or material published by you through the service. This indemnity also covers reimbursement of legal costs that Stugknuten may incur in connection with such claims.

Technical adjustments of the service

The service is provided as a platform for communication and the exchange of information between lessors and potential tenants. Our aim is to offer a service that is as comprehensive and user-friendly as possible. To that end, we provide a number of technical features designed to enhance your overall experience. Some of these features consist of informational messages that are triggered by keywords in the messaging function between a lessor and a potential tenant. The purpose of these messages is to provide you, as a user, with easily accessible information about how the service works, along with reminders intended to increase security and confidence when using the service. These messages are visible to you alone.

Automated data processing

We would like to make you aware that, within the scope of the service, we use automated processing, including artificial intelligence (AI). The purpose of this processing is to improve our services, identify patterns and trends, and prevent misuse, fraud, and behaviors that are contrary to our Terms and Conditions or applicable law.

For example, automated analysis may be applied to interpret the content of booking requests (such as dates, number of guests, and requested properties) and to detect prohibited payment proposals, e.g., situations where a host asks a guest to make a payment outside the platform. Processing may also be used to gain a better understanding of user behavior and to provide the basis for tailored offers or marketing actions related to our services. All processing is carried out in accordance with applicable data protection legislation, based on legitimate interests and consent.

All automated processing is performed with appropriate technical and organizational security measures to safeguard your privacy. It is never used as the sole basis for automated decision-making that would have legal or similarly significant effects without a prior human review. By accepting these Terms and Conditions, you consent to such automated processing in relation to information you submit through messages or otherwise within the service.

Posting advertisements, advertising terms and payment terms

Advertising on stugknuten.com requires that the user complies with the conditions regarding the content of advertisements, as well as with what may generally be considered an ethically and morally sound standard. Stugknuten reserves the right, at its sole discretion and from time to time, to make such assessments.

General information about advertising
Stugknuten reserves the right to review the content of advertisements before publication. However, a review carried out by Stugknuten prior to publication shall not be interpreted as an approval of the advertisement’s content, nor shall it mean that Stugknuten assumes responsibility for the accuracy of the information provided. We therefore emphasize once again that you, as a user, remain solely responsible for all information you provide to Stugknuten within the scope of the intermediary service.

Advertising with booking and payment service
Advertising and rental through www.stugknuten.com takes place using our booking and payment service, which offers both lessors and tenants the best possible conditions for a smooth rental relationship. Advertising is free of charge, and payment for the service is made through a percentage-based fee on the rental amount, which is specified at the time of accepting a booking request. Additional information about the booking services can be found in the General Terms and Conditions for the Booking Service.

Addendum for existing customers with an ongoing legacy advertising service
If you, as a host, advertise on Stugknuten at a fixed price per individual listing, the applicable price will be the one stated in Stugknuten’s current price list for advertising. Payment for each listing is made at the time of ordering the service through the available payment options, and the ad will normally be published within 24 hours on weekdays. Since the service you purchase from us is fulfilled immediately upon publication of your ad, you consent to the service starting right away. You also acknowledge that this means you have no right of withdrawal under the Distance Contracts Act. Normally, the Distance Contracts Act grants consumers a 14-day right of withdrawal after entering into an agreement, but an exception applies where you as the user have agreed that the service begins immediately and that the right of withdrawal therefore does not apply. By submitting your ad for publication, you agree to this exception. The advertising period for a fixed-price listing is considered one continuous period, regardless of whether you as the user choose to deactivate your ad at any point during that period. Renewal of an advertising period can take place no earlier than 30 days before the end of the current period. A renewal made earlier than this will be treated as the start of a new advertising period. You may edit your ad during the advertising period and add optional features to it. Please note, however, that any added features will follow the same advertising period as the original listing.

Inquiry about availability and rental

Through the intermediary service, it is possible to send a request to the lessor regarding the possibility of renting the advertised property for a specific period of time. The handling of the request and response takes place via Stugknuten’s intermediary service, and confirmation of the possibility to rent the property is accompanied by the terms for the rental period, such as price, and other relevant details. Payment for the rental period is made through Stugknuten’s payment solutions, which are subject to specific terms and conditions available in the General Terms and Conditions for the booking service. The terms are designed to establish security for both parties when renting through Stugknuten.

Changes in the services and the availability of the service

Stugknuten continuously works on developing the service to ensure that you, as a user, receive the best possible experience when visiting www.stugknuten.com as well as when using our services. However, this means that the service may at times be unavailable due to maintenance. Naturally, we strive to minimize any downtime, but we wish to make it clear that we assume no liability towards you as a user for periods when the service cannot be used or when your listing is not visible. Nor do we make any deductions from listing fees or extend listing periods due to service unavailability. If the service is unavailable for a continuous period exceeding one week, you are, however, entitled to compensation. Compensation is only granted for the period during which the service was unavailable due to circumstances attributable to Stugknuten, and any such request must be sent to info@stugknuten.com. The compensation is calculated based on the listing cost divided by the number of days covered by the listing period, multiplied by the number of days the service was unavailable. If the unavailability is due to circumstances beyond our control or caused by reasons that Stugknuten could not reasonably have avoided, we assume no liability towards you as a user.

Force Majeure

Stugknuten shall never be liable for damages or pay compensation for any unavailability of the service that is due to circumstances beyond Stugknuten’s control, which Stugknuten could neither foresee nor reasonably have been expected to foresee. Such circumstances constituting grounds for release from liability may include, for example, war or acts of war, civil war, mobilization or military conscription of a similar scope, rebellion and riots, terrorism, sabotage, fire, flooding, natural disasters, epidemic, pandemic, interruptions in public communications, interruptions in public energy supply, strike, lockout or other general or local labor dispute (even if Stugknuten itself is a party to the dispute), seizure, decisions of authorities, trade, payment or currency restrictions, or comparable circumstances.

Use of data for information and marketing purposes

Stugknuten reserves the right to send messages by electronic means for marketing purposes to registered users. If you, as a user, have indicated that you do not wish to receive information for marketing purposes, such information will not be sent. If a user wishes to change their previous preference, the user shall notify Stugknuten by sending a request to info@stugknuten.com or by following the deactivation link included in the email communications. Stugknuten also reserves the right to use published advertisement material for marketing purposes when promoting the service

Improper use of the service

In the event that a user breaches our terms, misuses the service, or otherwise uses the service or any part of the service in a manner that does not adhere to an ethical and morally sound approach, and does not remedy such conduct within five (5) days after we have notified you of our position and the reasons for it, we reserve the right to immediately terminate your user account. Repeated breaches of the terms will also result in the termination of your user account, even if remedies are made. Misuse of the service shall include, but not be limited to, material or repeated deficiencies in relation to the advertised conditions or in the relationship with tenants in connection with the rental of properties, of which Stugknuten becomes aware. In the event of a dispute between Stugknuten and you as a user involving automated processing (e.g. suspension or restriction of an account due to an automated analysis), you as a user have the right to request a manual review. It should be emphasized once again that the user bears sole responsibility for ensuring that the information posted on www.stugknuten.com is accurate and in accordance with the terms governing the use of the service.

Changes in terms

Just as we may implement changes to our service, we may also make changes to these Terms and Conditions. The latest version of the Terms and Conditions is always available on Stugknuten’s website www.stugknuten.com.

Termination of the service

You may terminate the service at any time you may find appropriate. However, if you choose to terminate the service during the agreed term, no refund will be made of any fees already paid for purchased services, regardless of whether such services remain unused. Upon such termination, we will also permanently delete all data relating to you that has been processed within the scope of providing the service

Transfer of agreement

The rights and obligations under this contractual relationship may not be assigned by the Lessor or the Lessee. However, Stugknuten shall have the right to assign the contractual relationship, provided that such assignment does not entail any changes to the conditions for you as a user.

Applicable law

As we are a Swedish company conducting business in Sweden, Swedish law shall govern our contractual relationship and these Terms and Conditions. Any dispute between you as a user and Stugknuten shall be settled by a Swedish court of law.
